1. Introduction & Acceptance of Terms

By downloading, accessing, or using Moments by Kliko ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the App.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the App after changes constitutes acceptance of the updated terms.

2. Eligibility & User Accounts

To use Moments by Kliko, you must be at least 13 years old. By creating an account, you confirm that you meet this age requirement.

You can create an account using Google, Facebook, or Apple sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3. Event Creation & Participation

Users can create events and generate unique invite codes to share with guests. Event creators are responsible for managing their events, including who receives invite codes and has access to the event gallery.

By joining an event using an invite code, you agree to participate according to the event creator's guidelines and our community standards.

Event creators can remove participants or delete events at any time. Removed participants will lose access to that event's content.

4. User-Generated Content (Photos & Media)

You retain ownership of all photos and media you upload to Moments by Kliko. However, by uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content for the purpose of providing our services.

You are solely responsible for the content you share. Do not upload content that:

• Infringes on the rights of others
• Contains illegal, harmful, or offensive material
• Violates any applicable laws or regulations
• Contains personal information of others without their consent

We reserve the right to remove any content that violates these terms or our community standards without prior notice.

5. Permissions & Content Usage Rights

The App requires access to your device camera and photo library to function properly. You can manage these permissions in your device settings at any time.

Photos you share within an event are visible to all participants of that event. By sharing photos in an event, you grant other event participants the right to view and download those photos for personal, non-commercial use.

We do not claim ownership of your content and will not use it for commercial purposes without your explicit consent.

6. Privacy & Data Handling

Your privacy is important to us. We collect and process personal information in accordance with our Privacy Policy. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

We use industry-standard security measures to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

7. Intellectual Property

The App, including its design, features, functionality, and content (excluding user-generated content), is owned by Kliko and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or included software without our prior written consent.

"Moments by Kliko," the Kliko logo, and other marks are trademarks of Kliko. You may not use these marks without our prior written permission.

8. Acceptable Use Policy

You agree to use Moments by Kliko only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Impersonate or attempt to impersonate another user or person
• Upload malicious code, viruses, or any harmful content
• Attempt to gain unauthorized access to the App or related systems
• Interfere with or disrupt the App's functionality
• Harass, abuse, or harm other users
• Use automated systems or bots to access the App
• Scrape or collect data from the App without permission

9. Account Suspension & Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that we deem inappropriate or harmful to other users.

You may delete your account at any time through the App settings. Upon account deletion, your profile information will be removed, but content you've shared in events may remain visible to other event participants.

If your account is terminated for violations, you may not create a new account without our express permission.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, secure, or error-free. We are not responsible for any loss of data or content.

We do not endorse, verify, or take responsibility for user-generated content. Users are solely responsible for the content they share.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLIKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Unauthorized access to or alteration of your content
• Any content, conduct, or data of third parties on the App
• Any other matter relating to the App

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the past twelve months, or $100, whichever is greater.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.

Nothing in these Terms excludes, restricts, or modifies any consumer rights you may have under Australian Consumer Law or other applicable consumer protection laws.
